Tennessee Estate Planning after Divorce: Remember to make the important changes!

Once your divorce is finalized in Tennessee, it is always a good idea to meet with an estate planning attorney to discuss any changes you wish to make to your plan. Remember that there is an injunction in place in Tennessee that doesn’t allow you to make certain changes while the divorce is proceeding, but these changes should be made as soon as possible after the Final Divorce Decree is entered by the court.

Important changes to remember:
• Change your Life Insurance Beneficiaries
• We have had people call our office and state they are trying to probate their brother’s estate and his ex-wife was still listed as the beneficiary on the policy. Unfortunately, in most circumstances, it is too late at this point. Remember to make those changes!
• Review Deeds
• Make sure Deeds reflect what was decided in the divorce decree.
• Update Powers of Attorney
• It is a good idea to appoint a new power of attorney for both medical decisions and business decisions after the divorce.
• Modify your Last Will and Testament
• You will probably want to make some changes to your Will in order to provide for other family members, friends, and your children.
