New US Immigration Policy

Today President Obama announced a change in the immigration policy in which his administration will stop deporting younger, law abiding illegal aliens. While many believe this to be more of a political move, we wanted to look at it from a constitutional side. The news debates will be over whether the law is right or wrong, we wanted to take a non-political approach to the policy’s enforcement. There are many hurdles this policy must jump to meet a constitutionality requirement. One main one is that the policy itself discriminates based on age. Another foreseeable problem is Congress, not the executive branch, has the power to control immigration. It will be interesting to see if this policy gets challenged on a constitutional basis.
