Nashville filing a nuisance lawsuit against a gang

WSMV recently posted a story about Nashville filing a lawsuit against alleged members of the Kurdish Pride Gang. The lawsuit seeks to have the gang declared a public nuisance.

While most people would agree that a gang is definitely a nuisance in the traditional sense of the word, declaring a gang a “public nuisance” under the law of torts may be a little more difficult. Typically a plaintiff in a public nuisance suit must suffer some unique damage that the public at large does not suffer. Even if proved, how will the declaration be enforced? This will be an interesting case to follow.
